These Terms of Use ("Terms") govern your access to and use of the website ResumeAdvisor.app (the "Site") and any related services (collectively, the "Services"). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site or Services.

1. Changes to Terms

We may modify these Terms at any time in our sole discretion by updating this page. When we do, we will revise the "Last updated" date above. Your continued use of the Services after the posting of revised Terms constitutes your acceptance of the changes.

2. Use of Services

You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations. You are responsible for your conduct and any content you upload or transmit through the Services.

3. Prohibited Content; Malware

You may not upload, transmit, or otherwise distribute any files or content that contain viruses, Trojan horses, worms, ransomware, spyware, or any other harmful or malicious code ("Malware"). Any violation of this Section constitutes a material breach of these Terms and may result in immediate suspension or termination of your access, without notice. We reserve the right to refer any suspected criminal activity to law enforcement agencies for prosecution.

4. User Accounts

To access certain features of the Services, you may be required to register for an account and provide a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Data Retention

  1. Operational Data. We collect and retain only:

    1. Your email address;
    2. Your purchase receipt identifier; and
    3. Metadata regarding creation and modification timestamps ("Operational Data").

  2. Deletion of Non‑Operational Data. All non‑Operational Data is permanently deleted within forty‑eight (48) hours of collection, except as otherwise required by law or as necessary to enforce these Terms.

6. Credit Request Data

In the event you submit a request for Service credit, we will retain any materials you have uploaded solely for the purpose of processing and reviewing that request. Upon completion of the credit review process, such materials will be permanently deleted, unless retention is otherwise required by law.

7. Third‑Party AI Services

Your use of the Services may involve transmission of content to third‑party AI service providers (e.g., OpenAI). You acknowledge and agree that:

  1. OpenAI’s data-use and retention policies are subject to change without notice;
  2. OpenAI may retain transmitted data for up to thirty (30) days or as otherwise set forth in its published policies;
  3. ResumeAdvisor.app makes no representations or warranties regarding any third party’s data practices and disclaims all liability in connection therewith to the fullest extent permitted by law;
  4. You should review the applicable third‑party privacy policy for further details.

8. Third‑Party Network & Hosting Services

  1. Cloudflare. All user requests are routed through Cloudflare, which may collect and store information regarding your IP address, geographic location, and request headers. ResumeAdvisor.app is not responsible for Cloudflare’s data-collection or use practices. You should consult Cloudflare’s documentation for more information.

  2. Hostinger. Our Site is hosted on Hostinger, which may collect or retain certain information about you. ResumeAdvisor.app disclaims all liability for any data practices of its hosting provider.

9. Intellectual Property

All content, features, and functionality on the Site and Services (including text, graphics, logos, icons, images, and software) are the exclusive property of ResumeAdvisor.app or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Termination

We may suspend or terminate your access to the Site or Services at any time, with or without cause or notice, including for violation of these Terms. Upon termination, all rights granted to you under these Terms will immediately cease.

11. Disclaimers; No Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ResumeAdvisor.app DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ResumeAdvisor.app OR ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

13. Indemnification

You agree to defend, indemnify, and hold harmless ResumeAdvisor.app and its officers, directors, employees, contractors, agents, affiliates, and licensors from and against any claims, liabilities, damages, losses, or expenses arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

14. Governing Law; Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of laws provisions. Any dispute arising under or relating in any way to these Terms shall be subject to the exclusive jurisdiction and venue of the state and federal courts located in King County, Washington.

15. General Provisions

  1. Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
  2. Waiver. No waiver of any term or condition shall be deemed a further or continuing waiver of such term or condition.
  3. Entire Agreement. These Terms constitute the entire agreement between you and ResumeAdvisor.app with respect to the Services and supersede all prior or contemporaneous agreements, understandings, or communications, whether oral or written.
